Terms of Use
These terms are an agreement between you and Caprilis Investments LLC ("we," "us"), the owner and operator of the Boatze app and website ("Boatze"). They include our Assumption of Risk, Release of Liability and Waiver and our Privacy Policy. You accept them by checking the box when you create an account, or when you're asked to accept a new version. If you don't agree, don't use Boatze.
1. Read this first: navigation safety
You use Boatze at your own risk. The Liability Waiver you accept at sign-up releases Caprilis Investments LLC from claims connected with your use of Boatze, including claims based on its negligence. Read it.
Boatze is an awareness tool, not a navigation instrument. Reports come from other users and may be wrong, late, or missing. Routes, depths, charts, weather and tide information may be inaccurate or out of date. Boatze is not an official nautical chart and is not certified for navigation.
- You, as the operator, are solely responsible for the safe operation of your vessel, keeping a proper lookout, and following navigation rules and local laws.
- Always use official charts, aids to navigation, local notices and your own judgment. Never rely on Boatze alone for depth, position or route.
- Don't interact with your phone in a way that distracts you while underway. Set up routes and alerts before you leave, or have a passenger handle the app.
- Obey all speed, no-wake, manatee and wildlife protection rules at all times. Patrol reports are meant to encourage safe, legal operation. They are not a tool to avoid enforcement, and the absence of a report means nothing about whether rules apply.
Outside U.S. waters, the charts are not official. Official NOAA chart data covers U.S. waters only. In other waters, including the Bahamas and Mexico, Boatze builds its charts and routes from:
- Shoreline: OpenStreetMap land data, compiled by volunteers. It may be incomplete, out of date or misplaced, and it doesn't show reefs, rocks, wrecks or other hazards reliably.
- Depth: the GEBCO global grid, a coarse world model with one depth value about every 460 meters (1,500 feet). It marks broad shallow banks only. It does not show channels, sandbars, rocks or coral heads, and on many shallow banks its depth is estimated rather than surveyed.
A route in these waters may cross water too shallow for your vessel, or hazards the data doesn't show, even when Boatze shows it as clear. The app warns you when a route leaves U.S. waters. There, you must use official or local charts for that country, watch your depth sounder at all times, keep a proper lookout, and read the water. Don't follow a Boatze route through unfamiliar shallow water.
2. Who can use Boatze
You must be at least 13 years old to use Boatze, and if you are under 18 you need the permission of a parent or guardian. You must give accurate information when you sign up and keep your password secure. You're responsible for activity on your account.
3. Your content
"Your content" means the reports, notes, spots, photos, fuel prices and other material you post. You keep ownership of it. By posting, you give Boatze a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, adapt and distribute it in connection with operating and promoting Boatze. This license ends when your content is deleted from our systems, except where it has already been shared with other users or we must keep it by law.
You confirm that you have the rights to what you post and that it is accurate to the best of your knowledge.
4. Community rules
Don't use Boatze to:
- Post reports you know are false, or flood the map with fake or duplicate reports.
- Harass, threaten, or target any person, vessel, business or officer.
- Post anyone's personal information, private property details without permission, or photos where people can be identified without their consent.
- Post illegal, hateful, sexual or violent content, or advertising and spam.
- Plan or help commit a crime, or interfere with law enforcement or emergency responders.
- Scrape, copy or resell Boatze data, reverse engineer the app, overload our systems, or access accounts or data that aren't yours.
We may remove content and suspend or close accounts that break these rules, at our discretion and without notice.
5. Emergencies
Boatze is not an emergency service. Reports of accidents or boats adrift are not sent to authorities. In an emergency, call VHF Channel 16 or 911.
6. Third-party data and services
Boatze shows data from third parties such as NOAA, the National Weather Service, OpenStreetMap contributors (map data © OpenStreetMap contributors, available under the Open Database License), the GEBCO Compilation Group (GEBCO Grid), Open-Meteo and Google. We don't control that data and aren't responsible for its accuracy or availability. Links to marinas, restaurants and other businesses are for convenience; we don't endorse them.
7. Our app
Boatze, its name, logo, design and software belong to us and are protected by law. We give you a personal, non-transferable, revocable license to use the app for its intended purpose. We may change, add or remove features, or stop offering Boatze, at any time. Boatze is free today; if we ever offer paid features, we'll show the price and terms before you pay.
If you download Boatze from the Apple App Store, you also agree to Apple's Licensed Application End User License Agreement. Apple is not responsible for the app or its support.
8. Disclaimer of warranties
BOATZE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DON'T WARRANT THAT REPORTS, ROUTES, DEPTHS, CHARTS OR CONDITIONS ARE ACCURATE OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
9. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, CAPRLIS INVESTMENTS LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, PROPERTY OR VESSEL DAMAGE, GROUNDING, CITATION OR FINE, ARISING FROM YOUR USE OF OR RELIANCE ON BOATZE OR ON CONTENT POSTED BY OTHER USERS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO BOATZE IS LIMITED TO THE GREATER OF US$50 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some places don't allow these limits, so they may not fully apply to you.
10. Indemnity
You agree to defend, indemnify and hold harmless Caprilis Investments LLC and its members, managers, officers, employees and contractors from claims, damages and costs (including reasonable attorneys' fees) that arise from your content, your use of Boatze, your operation of a vessel, or your breach of these terms.
11. Ending your use
You can stop using Boatze and delete your account at any time (see Delete account). We may suspend or end your access if you break these terms or if we stop offering Boatze. Sections 3, 8, 9, 10 and 12, and the Liability Waiver, continue after your account ends.
12. Governing law
These terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Florida, and you and we consent to their jurisdiction. Before filing a claim, please contact us so we can try to resolve it informally. To the extent permitted by law, claims may be brought only individually, not in a class or representative action, and you and we each waive a jury trial.
13. Changes
We may update these terms. We'll change the version and date at the top. For significant changes, the app will ask you to accept the new version before you continue.
14. Marketing email
Marketing email is optional. We only send it if you checked the box to receive it, and you can stop it any time in Settings or from the unsubscribe link.
